Road rage to the max

A fight apparently stemming from a fit of road rage on Highway 12 Wednesday morning included a shovel, a pickax and a .357-caliber revolver.

The incident lead to the arrest of a 21-year-old Helena man on a felony charge of assault with a weapon, according to Justice Court documents filed Thursday.

Jace Roy Devine struck a man with a shovel twice during the altercation, the documents allege.

It all started when Devine’s father was driving his truck on Highway 12 East at about 9 a.m. and cutoff another vehicle, according to court documents.

That car then pulled in front of the truck, in which Devine was a passenger, and the driver waved.

Devine then began leaning out of the passenger-side window, yelling obscenities, gesturing at the other vehicle and telling the occupants to pull to the side of the road, the documents stated.

Devine’s father then passed the other vehicle and slammed on his brakes. The alleged victim’s vehicle had to be slowed suddenly to avoid ramming into the truck, the documents said.

Both vehicles came to a stop at the side of the road.

Devine allegedly exited his father’s truck and grabbed a wood-handled shovel from the vehicle’s bed, the court documents said.

The accused approached the other vehicle’s passengers — two brothers and their father — who were now also out of their vehicle.

According to court documents, Devine then swung the shovel at one of the brothers, hitting the man in the ribcage. The alleged victim grabbed the shovel and threw it to the ground.

The man then grabbed Devine and the two began wrestling.

Devine’s father then got out of his truck, grabbed a pickax-type tool and began walking toward his son and the other man while yelling at them to separate, the documents said.

The alleged victim’s father then brandished a .357 caliber revolver and ordered Devine’s father to drop the ax. The two grappling men were pulled apart, the paperwork said.

Devine got up from the ground, retrieved the shovel and allegedly struck the man again. The man told Lewis and Clark County sheriff’s deputies that Devine “jabbed” him in the stomach with the implement’s blade the second time, according to court documents.

Shortly after the assault, East Helena police stopped the truck driven by Devine’s father near the Highway 12 East viaduct.

Devine was arrested and later in the day posted $25,000 bond.

While being transported to jail, Devine told a deputy that he got in a fight over “road rage.”
