Charge against college president dismissed

By The Associated Press - 08/16/08

BILLINGS (AP) — A battery charge against Rocky Mountain College President Michael Mace has been dismissed following his fulfillment of requirements in a pretrial agreement, The Billings Gazette reported.

About a year ago Mace was arrested and jailed in Indiana for a night, on allegations he struck a property developer during an argument. Mace pleaded not guilty to the misdemeanor charge and was released on bail of $2,500.

He subsequently entered a program intended to resolve cases before they reach the trial stage. Charges may be dismissed if accused persons participating in that program meet certain requirements.

Mace was to pay a $305 fee for the program, meet with a counselor to discuss anger management and complete 40 hours of community service by Aug. 1.

Jamie Campbell, deputy prosecutor for Indiana’s Hamilton County, said Mace met the conditions and although the case against him has been dismissed, it remains on his record.

According to court documents, developer and homebuilder David Klain claimed that on June 13, 2007, his face was hit by Mace at the Klain office in Carmel, Ind., an area where Mace owned a townhouse. The college president has said he did not hit Klain, but pushed him in frustration after repeatedly asking him to fix problems in the townhouse.

In a statement Mace issued last year he apologized and said he regretted embarrassment inflicted on Rocky Mountain College and his family. Trustees for the Billings college said they supported Mace’s presidency.
