A jury trial of two cousins who allegedly coerced a 16-year-old Billings girl to engage in sexually explicit conduct continued Wednesday in federal court in Helena with both defendants taking the stand.
Federal prosecutors say Fritz Anderson, 29, of Billings and his cousin Raeshon Dozier, 34, of California persuaded the female minor to engage in sexual acts for the purpose of producing a video knowing it would be disseminated. The incident was recorded in five videos on a cell phone, which were shown during the trial Wednesday.
Anderson faces additional charges for distributing ecstasy and marijuana to a person under the age of 21 and possession of child porn.
Prosecutors claim that not only did Anderson provide controlled substances to the minor but then used her for sexual exploitation while she was under the influence.
The evening in question took place on Jan. 13, 2007, in a room at the Ramada Inn in Billings allegedly rented by Dozier, who was in town visiting Anderson.
Dozier testified Wednesday that he had no intention of having a party or engaging anyone in any sort of sexual acts.
"I just came out here to stay for a couple days and visit," he said. "In no way whatsoever did I arrange anything. ... What happened was all spontaneous. I got to the room just to have a place to say."
Dozier said no one involved had any intention of producing child pornography, while Assistant U.S. Attorney James Seykora said that because the 16-year-old was intoxicated, she was induced to participate.
"Nobody was forcing anybody to do anything," Dozier said. "It was just a party."
Anderson testified that he had no idea the alleged female victim was underage. His attorney, Brian Fay, of Bozeman said the depiction of the alleged female victim in the videos doesn't indicate that she is under 18.
"There was no way I could have possible known (her age)," Anderson said under oath. "I thought everybody there were adults."
Dozier also claims he was unaware the alleged victim was a minor.
"I had no idea she was a minor," he said. "I had no idea, I just met the girl."
Both defendants have pleaded not guilty to all charges. If convicted, Anderson and Dozier face a mandatory minimum of 15 to 30 years in prison, a $250,000 fine and a lifetime of supervised release.
Anderson also faces 30 counts of drug-related charges, and a federal court date is set for April 7 in Billings.
Closing arguments for this case are scheduled to begin at 9:30 a.m. Thursday.
