Three juveniles are being charged as adults for their alleged involvement in the planned armed robbery of a Helena Subway restaurant.
Grant Lightfoot, 17, faces felony charges of attempted robbery and conspiracy, as well as one misdemeanor count of possession of drug paraphenalia.
Allyn Dennis, 16, and Shane Romero, 17, face felony charges of conspiracy and accountability in connection with the attempted robbery.
Two other juveniles, identified only by their initials, probably will have delinquency petitions filed against them, according to Lewis and Clark County Attorney Leo Gallagher.
Police reports state that in October, Romero, Dennis and Lightfoot, along with the two other juveniles, discussed ways to rob a local business.
On Oct. 31, they allegedly took a .32-caliber handgun from one juvenile's home. Later that evening Lightfoot, Romero and Dennis, along with another juvenile, drove to Wal-Mart and picked up a can of black spray paint to make the gun appear more intimidating, and painted it in the parking lot of the Ice Palace above the Lola Street Subway restaurant.
Lightfoot allegedly took a rubber Halloween mask to conceal his identity, then walked to the Subway store, "knowing that to accomplish the theft of money from the store, he would display the handgun to put any customers or employees in fear of immediate bodily injury," Gallagher wrote in court documents.
But when Lightfoot got to the store, he saw a police officer was inside, as were many customers. The group waited for another half hour before deciding to leave.
The group then allegedly decided to target the downtown Domino Pizza restaurant. Dennis parked the vehicle nearby and Lightfoot again donned the masked and walked to the store. However, Gallagher writes that Lightfoot also once again returned to the car without getting any money.
Lightfoot told the group that they would get together the next night and that the robbery would be completed and was adamant about getting the job done, Gallagher wrote.
But their effort was thwarted after Helena police learned of the pending robbery attempt, and pulled over Dennis' vehicle with her and Lightfoot inside. The officers said they saw a Halloween mask in plain view on the rear seat, and that Lightfoot admitted he had been planning to rob the Subway store.
A marijuana-smoking pipe allegedly was found in one of Lightfoot's socks while he was detained by police, which led to the third charge against him.
Lightfoot and Dennis are on house arrest. No court date has been set in their case, or for the charges against Romero.
